Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you and Simonova Inc ("Company", "we", "us", or "our"), the operator of BrindaWorld.ca ("BrindaWorld" or the "Site"), incorporated and operating in the Province of New Brunswick, Canada.

By accessing or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are a parent or guardian permitting a child to use the Site, you agree to these Terms on behalf of that child and accept responsibility for their use of the Site.

If you do not agree to these Terms, you must immediately discontinue use of the Site.

1. Eligibility and Parental Consent

BrindaWorld is an educational platform designed for children of all ages. Use of the Site is subject to the following eligibility conditions:

• Children under 13 may use the Site only with the knowledge and active consent of a parent or legal guardian who agrees to these Terms on their behalf.
• Users aged 13 and over may use the Site on their own behalf, subject to these Terms.
• Parents and guardians are responsible for monitoring their child's online activities and ensuring that use of the Site is appropriate for their child's age and maturity.

No account, registration, or personal information is required to use the Site. The Site is designed to be accessible to children without requiring them to provide any personal details.

2. Access and Permitted Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial, educational, and entertainment purposes.

Permitted uses include:

• Playing the educational games and activities on the Site;
• Reading the stories, learning resources, and educational content;
• Using the translation, language-switching, and accessibility features;
• Printing certificates generated by the Site for personal, non-commercial use;
• Sharing the URL of the Site (brindaworld.ca) with others for educational purposes.

This licence does not include any right to download, reproduce, redistribute, commercialise, or create derivative works from any content on the Site except as expressly permitted in these Terms or by us in writing.

3. Prohibited Conduct

You agree that you will not, and will not permit any child in your care to:

• Use the Site for any unlawful, harmful, abusive, or fraudulent purpose;
• Attempt to gain unauthorized access to any part of the Site or its underlying systems;
• Copy, scrape, crawl, index, or systematically extract content from the Site by automated means;
• Reproduce, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Site;
• Remove or alter any copyright, trademark, or other proprietary notices on the Site;
• Use the Site's content for commercial purposes, including resale, redistribution, or monetisation, without our prior written consent;
• Introduce viruses, malicious code, or any other technology that may harm the Site, its systems, or its users;
• Impersonate BrindaWorld, Simonova Inc, or any other person or entity in connection with use of the Site;
• Use the Site in any manner that could overburden, disable, impair, or damage our infrastructure or interfere with other users' enjoyment of the Site.

Any violation of the above may result in immediate termination of access to the Site and may be reported to appropriate law enforcement authorities where applicable.

4. Intellectual Property

4.1 Ownership

All content on BrindaWorld.ca, including but not limited to text, stories, educational materials, games, game mechanics, graphics, icons, illustrations, colour schemes, brand elements, badges, certificates, the name "BrindaWorld", the character "Brinda", and all associated software code, is the exclusive intellectual property of Simonova Inc or its licensors, and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

4.2 Women Heroes Content

Biographical content about historical and public figures featured in the Women Heroes section of the Site is presented for educational purposes. Such content is original writing by Simonova Inc and does not reproduce copyrighted third-party material.

4.3 Limited Personal Use Licence

You may print copies of certificates generated by the Site solely for your own personal, non-commercial use (for example, to celebrate a child's achievement). This permission does not extend to bulk reproduction, commercial printing, distribution, or any other use without our prior written consent.

4.4 No Implied Licence

Nothing in these Terms grants you any right, title, or interest in any intellectual property of Simonova Inc beyond the limited access licence described in Section 2. All rights not expressly granted are reserved.

4.5 Feedback

If you submit feedback, ideas, or suggestions regarding the Site ("Feedback"), you grant Simonova Inc a royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, and incorporate such Feedback into the Site or other products without any obligation to you.

5. Educational Content and Accuracy

The games, stories, quizzes, facts, and other educational content on BrindaWorld are designed and curated to be age-appropriate, accurate, and engaging for children. However:

• Educational content is provided for general informational and entertainment purposes only. It is not a substitute for formal schooling, professional tutoring, or curriculum-aligned instruction.
• While we make reasonable efforts to ensure accuracy, we do not warrant that all content is free from error, omission, or inaccuracy, particularly given the dynamic nature of educational knowledge.
• Content related to geography, science, history, and public figures reflects information available at the time of publication. We update content periodically but cannot guarantee that all information is current.
• Chess rules, coding logic, mathematical operations, and game mechanics are designed for introductory learning and may be simplified for accessibility.

6. Third-Party Services

BrindaWorld uses third-party services to operate and improve the Site. These services operate independently and are subject to their own terms of service and privacy policies:

• Google Analytics — used for anonymous traffic analytics (Google Privacy Policy);
• Google AdSense — used to display advertisements (Google Advertising Policies);
• Google Translate — used to provide multi-language access (Google Privacy Policy);
• Google Fonts — used to render website typography;
• Hostinger International — our web hosting provider.

We are not responsible for the content, privacy practices, or terms of any third-party service. Links to third-party websites or services from within our Site do not constitute our endorsement of those services.

7. Advertising

BrindaWorld is a free platform supported in part by advertising revenue through Google AdSense. By using the Site, you acknowledge that:

• Advertisements may be displayed on the Site, primarily on the home page;
• Advertisements are served by Google and are subject to Google's advertising policies;
• We do not control the specific advertisements displayed, though we have designated the Site as child-directed content to the extent supported by Google's tools;
• We do not endorse any products or services advertised on the Site;
• Revenue from advertising supports the free operation of BrindaWorld for all users globally.

8. Disclaimers and Limitation of Liability

8.1 No Warranties

THE SITE AND ALL CONTENT, GAMES, FEATURES, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that the Site will be available at all times, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMONOVA INC, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SUCCESSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of incidental or consequential damages, our liability shall be limited to the maximum extent permitted by applicable law.

8.3 Educational Outcomes

We make no guarantee or representation regarding any specific educational outcome, learning achievement, or academic result arising from use of BrindaWorld. The Site is a supplementary educational resource and is not a substitute for formal education.

9. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Simonova Inc and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Site in violation of these Terms;
• Your violation of any applicable law or regulation;
• Your violation of any third party's rights in connection with your use of the Site.

10. Termination of Access

We reserve the right, in our sole discretion, to suspend or terminate access to the Site for any user who violates these Terms, engages in conduct that we consider harmful to the Site or its users, or for any other reason we deem appropriate, without notice and without liability.

We also reserve the right to modify, suspend, or discontinue the Site or any part thereof, temporarily or permanently, at any time and without notice. We shall not be liable to you for any modification, suspension, or discontinuation of the Site.

11. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated through a prominent notice on the Site.

Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to conflict of law principles.

12.2 Jurisdiction

Any dispute arising out of or relating to these Terms or the use of the Site shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in the Province of New Brunswick, Canada. By using the Site, you consent to personal jurisdiction in New Brunswick for the purpose of litigating any such dispute.

12.3 Informal Resolution

Before initiating any formal legal proceedings, we encourage users to contact us at legal@brindaworld.ca to attempt to resolve any dispute informally. We are committed to addressing concerns promptly and in good faith.

12.4 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

12.5 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12.6 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simonova Inc regarding your use of the Site and supersede all prior agreements, representations, and understandings.

12.7 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Simonova Inc.
